A compliance complaint (S-0660-99/00) was filed by parents of a San Francisco Unified School District special education student. The District was found out of compliance with IDEA 97. In order to correct the noncompliance, the California Department of Education has ordered the District to notify staff of the following California Code of Regulations 3052(i)7

5 CCR 3052(i)7: Anytime a "Behavioral Emergency Report" is written regarding an individual who does not have a behavioral intervention plan, the designated responsible administrator shall, within two days, schedule an IEP team meeting to review the emergency report, to determine the necessity for a functional analysis assessment, and to determine the necessity for an interim behavioral intervention plan. The IEP team shall document the reasons for not conducting the assessment and/or not developing the interim plan. Compliance with this requirement is mandatory.
