A compliance complaint (SN# 0051-99/00) was filed by parents of a San Francisco Unified School District special education student. The District was found out of compliance with IDEA 97. In order to correct the noncompliance, the California Department of Education has ordered the District to notify staff of the following of Education Code 56320(f) and 5 California Code of Regulations 3027(f).

5 California Code of Regulations 3027: All pupils being assessed for initial and three-year review for special education services shall have had a vision and hearing screening, unless parental permission was denied.

Education Code 57320(f): Before any action is taken with respect to the initial placement of an individual with exceptional needs in special education instruction, an individual assessment of the pupil's educational needs shall be conducted...The pupil [shall be] assessed in all areas related to the suspect disability including, where appropriate...vision...hearing, motor abilities, language function...and social and emotional status.
