A compliance complaint (SN-0621-98/99) was filed by parents of a San Francisco Unified School District special education student. The District was found out of compliance with IDEA 97. In order to correct the noncompliance, the California Department of Education has ordered the District to notify staff of the following Education Code 56329(b) and 34 Code Federal Regulations 300.502(b).

EC § 56329(b).....A parent has the right to obtain, at public expense, an independent educational assessment of the pupil from qualified specialists, as defined by regulations of the Board, if the parent disagrees with an assessment obtained by the public education agency. However, the public education agency may initiate a due process hearing to show that its assessment is appropriate.....

34 CFR § 300.502(b)..... A parent has a right to an independent educational evaluation at public expense if the parent disagrees with an evaluation obtained by the public agency....If a parent requests an independent educational evaluation at public expense, the public agency must, without unnecessary delay, either....initiate a hearing to show that its evaluation is appropriate; or ensure that an independent educational evaluation is provided at public expense....
