A compliance complaint (SN# 0051-99/00) was filed by parents of a San Francisco Unified School District special education student. The District was found out of compliance with IDEA 97. In order to correct the noncompliance, the California Department of Education has ordered the District to notify staff of the following of Education Code 56321(a) and Education Code 56344.

Education Code 56321(a): Whenever an assessment for the development or revision of the individualized education program is to be conducted, the parent of the pupil shall be given, in writing, a proposed assessment plan within 15 days of the referral for assessment...unless the parent agrees, in writing, to an extension...

Education Code 56344: An [IEP] required as a result of an assessment of a pupil shall be developed within a total time not to exceed 50 days...from the day of receipt of the parent's written consent for assessment, unless the parent agrees, in writing, to an extension...
