    A. P. GIANNINI MIDDLE SCHOOL CONSTITUTION

     

    PREAMBLE

    We the students of A. P. Giannini Middle School, in order to generate a school which acknowledges student’s rights, responsibilities, and provides the opportunity for all students to experience quality education, do ordain and establish this constitution of A. P. Giannini Middle School.

     

    ARTICLE I

    Section I: Name

    The name of the student organization shall be the A. P. Giannini Middle School Student Association.

     

    Section II: Membership

    This organization shall consist of all regularly enrolled students at A. P. Giannini Middle School. Members of the faculty are eligible for ex-officio membership in this organization.

     

    Section III: Colors and Mascot

    The colors of the A. P. Giannini Middle School shall be royal blue and white. The blue represents TRUTH. The white represents HONOR. The mascot shall be the JAGUAR. The jaguar represents POWER and CUNNING.

     

    ARTICLE II

    Form of Government

    Section I: Organization

    The student body government shall consist of the Student Council.

     

    Section II: Student Council

    The Student Council shall consist of the officers of the student body and the presidents and representatives of the homerooms. It is the executive and legislative body of the Associated Students. A faculty advisor shall meet with the Council.

     

    ARTICLE III

    Student Body Officers

    Section I: Officers

    The elected officers of the A. P. Giannini Middle School student body shall be President, Vice President, Secretary, and Treasurer.

     

    Section II: Qualifications for Candidacy

    Candidates for President shall be in the Seventh grade. Candidates for Vice President shall be in the Seventh and Sixth grades. Candidates for Secretary and Treasurer shall be open to Sixth and Seventh grade.

    Candidates shall have good citizenship and scholarship records. On their current report cards (first and second report grades or last yearís) they may have no grade lower than a C, or no Uís in citizenship, and not more than one W. Any student who has a D or 2 Wís in the first report card period but makes the Honor Roll on the second report is eligible to run for a student body office.

     

    Section III: Nominations and Elections

    Any student wishing to become an officer of the A. P. Giannini Student Association must submit a petition. When the petition is completed and the studentís record is approved, the name shall be placed on the ballot. All approved candidates will address the student body at the assembly.

    A general election shall be held, at which time the names of the qualified candidates shall be placed on the ballot and the members of this association shall choose their officers from such candidates. If a candidate for any office shall receive a majority of all votes cast for that office at the primary election, that student shall be declared elected.

    Elections for the officers of this association shall be held annually, at the end of the school year, on a date to be fixed by the Student Council, in homeroom. The method of election shall be by secret ballot. The officers thus elected shall be inaugurated at a public ceremony.

     

    Section IV: Vacancies

    If the office of President should be vacated, the Vice President shall replace this officer. If any office other than President is vacated the Student Council shall elect a replacement. This student shall qualify according to this constitution.

     

    Section V: Duties of Student Body Officers

    PRESIDENT: The President shall preside at all student body meetings and assemblies. This officer shall be chairperson of the Student Council and appoint committee chairpersons. The President shall work closely with student body committees. The President shall also have such other powers and responsibilities as usually pertain to this office. The President is a member of the A. P. Giannini Middle School Site Council.

     

    VICE PRESIDENT: The Vice President shall preside over the meetings of the Student Council or assemblies of the Student Body when the President is absent. During the Student Council meeting the Vice President is to call the roll and keep the homerooms reminded about sending their Student Council representatives. This person shall be the chairperson of the service point committee. The Vice President shall also be in charge of all dances and other social activities and shall act as host or hostess at these social functions. The Vice President is a member of the A. P. Giannini Middle School Site Council.

     

    SECRETARY: The Secretary shall keep accurate written records of the Student Council meeting. The Secretary is responsible for typing the minutes, providing copies to homerooms and giving the original copy to the school bookkeeper. The Secretary is responsible for keeping all minutes in a notebook. The Secretary is also responsible for writing correspondence to people or organizations thanking them for their contributions to A. P. Giannini. The Secretary or the Treasurer will become a member of the A. P. Giannini Middle School Site Council. The remaining officer is an alternate member to the council.

     

    TREASURER: The Treasurer shall present the financial reports to the Student Council. The Treasurer is responsible to meet with the school bookkeeper for up-to-date budget matters. This office is also in charge of presenting budget requests for student body funds by school organizations or activities. The Treasurer shall conduct the Student Body Card drive. The Secretary or the Treasurer will become a member of the A. P. Giannini Middle School Site Council. The remaining officer is an alternate member to the council.

     

    Section VI: Qualifications for Holding Student Body Office

    In order to remain in office, a student body officer must maintain good scholarship and citizenship for each report period; that is, this student shall have no grade lower than a C, with no U and not more that one W. If an officer fails to maintain such standards he or she shall forfeit the office for that report period, but may be reinstated upon the direction of the principal. A disqualified officer shall be reinstated if grades are satisfactory the next period.

    If an office is vacant because of disqualification, Student Council shall fill the vacancy (Article III, Section 4) to serve until the disqualified student is reinstated or until the end of the term.

     

    ARTICLE IV

    Homeroom Officers

    Section I: Homeroom Officers

    Each homeroom shall have the following officers: President, Vice President, Secretary, Treasurer and Student Council Representative and Intramural Captain (s) if needed.

     

    Section II: Qualifications for Homeroom Candidacy

    All candidates for homeroom offices shall be elected by the homeroom students and shall have the approval of the homeroom teacher. All candidates for a homeroom office have membership on the Student Council. Homeroom officers shall have satisfactory scholarship and citizenship records.

     

    Section III: Nominations and Elections

    Homeroom elections shall be held during the first two weeks of the new term. Voting shall be by secret ballot.

     

    Section IV: Duties of the Homeroom Officers

    The President shall attend all meetings of the Student Council or send a representative. The President shall report back to the class on council business, and lead discussions during the homeroom meetings. The President represents the homeroom and shall assume other duties as required.

    The Vice President shall help the President in as many ways as possible and shall assume leadership of the homeroom in the presidentís absence.

    The Secretary shall take the minutes of all homeroom meetings and shall do the correspondence for the homeroom.

    The Treasurer shall conduct any fund raisers or drives in the homeroom involving the collection of the money. The Treasurer shall keep an accurate record of all money collected.

    The Intramural Captains shall keep an accurate record of the scores and organize the teams for noon-time games (elected only if needed).

     

    Section V: Qualifications for Holding Homeroom Office

    In order to remain in office, homeroom officers shall maintain satisfactory scholarship and citizenship grades. (F,D, or U would be unsatisfactory).

    If an officer fails to maintain satisfactory scholarship and citizenship the homeroom is to ELECT a new officer.

     

    ARTICLE V

    Powers and Duties of the Student Council

     

    As the governing body of the A. P. Giannini Middle School Student Association, the Student Council shall have the following powers, subject to the approval of the Principal.

     

    To make all laws or regulations for the student government and student activities.

    To approve the student body budget and the spending of student body funds.

    To approve activities planned by school organizations and classes.

    To submit amendments to this constitution to the student body for discussion and approval.

    To keep homerooms involved in the decision making process.

    To insure that the Preamble and the Constitution is applied to all students equally.

     

    ARTICLE VI

    Terms of Office

     

    Section I:

    All officers of the Student Body Association shall serve for one school year.

     

    Section II:

    Student Body Officers who do not maintain satisfactory scholarship or citizenship as described in this constitution or who do not carry out duties in a satisfactory manner shall be requested to be removed by the faculty sponsor and removed from office by the Principal.

     

    ARTICLE VII

    Amendments

     

    Section I:

    In order to amend this constitution, fifty members of the student body shall sign a petition which they submit to the Student Council. It must be approved by a Two-thirds vote of the council.

     

    Section II:

    The approved amendment shall then be published in the bulletin at least one day before a vote is held.

     

    Section III:

    The Student Council conducts a vote in the homeroom on the proposed amendment. For the amendment to pass, a majority of all votes cast is required.

     

    ARTICLE VIII

    Reservation

     

    State laws, rules and regulations of the Board of Education, of the office of the Superintendent of Schools, or a decision of the Principal shall take precedence over this Constitution in whole or in part.

     

    AMENDMENTS

     

    STUDENT’S BILL OF RIGHTS

    Amendment 1

    All the students have the right to a meaningful education.

     

    Amendment 2

    All students have the right to the maintenance of high educational standards.

     

    Amendment 3

    All students have the right to a meaningful curriculum.

     

    Amendment 4

    All students have the right to physical safety and protection of personal property.

     

    Amendment 5

    All students have the right to a safe building and sanitary facilities.

     

    Amendment 6

    All students have the right to consultation with teachers, counselors, and administrators and anyone else connected with the school.

     

    Amendment 7

    All students have the right to seek and hold office.

    Amendment 8

    All students will have the right to democratic representation on administration committees affection studentís rights.

     

    Amendment 9

    All students have the right to participation in the development of rules and regulations to which they are subject and the right to be notified of such rules and regulations.

     

    Amendment 10

    All students have the right to see their own personal files, cumulative folders, transcripts, deanís files, etc. in conformity with provisions laid out in the California State Education Code (Section 49061-49078) and to be notified if adverse comments are placed in such records.

     

    Amendment 11

    All students have the right to be involved in school activities if they so desire without being subject to discrimination on any basis, provided they meet with the reasonable qualifications of sponsoring organizations.

     

    Amendment 12

    All students have the right to present petition, complaints or grievances to school authorities and to receive prompt authoritative replies regarding the disposition of their petition, complaints or grievances.

     

    Amendment 13

    All students have the right not to be penalized in any way by the school administration for the beliefs they hold provided they do not violate the rights of others.

     

    Amendment 14

    All students have the right to receive respect from teachers and administrators, which would exclude their being subject to cruel and unusual punishments and especially those which are demeaning of derogatory, or which diminish their self-esteem (inappropriate name calling or put-downs).

     

    Amendment 15

    All students have the right to exercise their constitutionally protected rights of free speech and assembly on their own campus so long as they do not interfere with the operation of the regular school program. However, students must refrain from any distribution or display of materials that are obscene or libelous, or that advocate the commission of unlawful acts. (CA State Education Code Sec. 48916)

    Amendment 16

    All school wide contests Amendment. Spelling Bees and other academic contests shall have equal representation from all participating classes (unless sponsored for a particular program).
