Grievances Procedures

The SFUSD EED intends to fully comply with all applicable state and federal laws and regulations. Individual agencies, organizations and students, and interested third parties have the right to file a complaint regarding the SFUSD EED alleged violation of federal and/or state laws. This includes allegations of unlawful discrimination (Ed Code sections and Government Code section 11135) in any program or activity funded directly by the state or receiving federal or state financial assistance. SFUSD EED encourages the early, informal resolution of complaints whenever possible and appropriate at the school site. 

 Unresolved complaints may be filed in writing and signed with SFUSD's Office of Equity at the following address:

A complaint regarding a health and safety code violation at a SFUSD EED facility can be submitted using the Williams Complaint process and is also filed with the Office of Equity.

The Department of Social Services Community Care Licensing has a centralized complaint and information bureau, which maintains a complaint hotline that you can call. The phone number is 844-538-8766. You can also go to the Community Care Licensing website at www.ccld.ca.gov

Identification And Education Under Section 504

This Board Policy applies to the San Francisco Unified School District and the County Office of Education.

The Governing Board believes that all children, including children with disabilities, should have the opportunity to learn in a safe and nurturing environment. The Superintendent or designee shall work to identify children with disabilities who reside within the jurisdiction of the District in order to ensure that they receive educational and related services required by law.

The Superintendent or designee shall provide qualified students with disabilities with a free appropriate public education (FAPE), as defined under Section 504 of the federal Rehabilitation Act of 1973. Such students shall receive regular or special education and related aids and services designed to meet their individual educational needs as adequately as the needs of students without disabilities are met. (34 C.F.R. § 104.33)

In addition, qualified students with disabilities shall be provided an equal opportunity to participate in programs and activities that are integral components of the District’s basic education program, including, but not limited to, extracurricular athletics, interscholastic sports, and/or other nonacademic activities. (34 C.F.R. § 104.37)

The District’s local control and accountability plan shall include goals and specific actions to improve student achievement and other outcomes of students with disabilities. At least annually, the Superintendent or designee shall assess the District’s progress in attaining the goals established for students with disabilities and shall report these results to the Board. (Education Code § 52052, 52060)

In providing services to students with disabilities under Section 504, the Superintendent or designee shall ensure District compliance with law, including providing the students and their parents/guardians with applicable procedural safeguards and required notifications. Any dispute as to the identification, evaluation, or placement of any student with a disability shall be resolved in accordance with the processes specified in the “Procedural Safeguards” section of the accompanying administrative regulation.

This Administrative Regulation applies to the San Francisco Unified School District and the County Office of Education. 

The Superintendent designates the following position as the District’s 504 Coordinator to implement the requirements of Section 504 of the federal Rehabilitation Act of 1973 (34 CFR 104.7)

SFUSD provides equal access for students with disabilities by complying with the Americans with Disabilities Act (ADA) and other federal laws like Section 504 of the Rehabilitation Act, ensuring students receive a Free Appropriate Public Education (FAPE), equal opportunities in all programs, and accessibility of facilities and information. The district handles complaints through formal grievance procedures, focusing on stopping discrimination and ensuring recurrence is prevented.
